Customer Key Release

1. General:

The undersigned (the "Releasor") acknowledges that this release ("Release") is to be read in conjunction with any and all other release forms or waivers agreed to be the Releasor in connection with utilizing other services offered by Calgary Park & Jet Ltd. ("CPJ" or the "Releasee"), and that this Release shall not supersede or nullify any other such release or waiver.

2. Services:

For purposes of this Release, "Warm Car Start Services" means the following services which the Releasor authorizes CPJ to perform to the Releasor's parked vehicle after the Releasor has delivered custody of the vehicle and keys to CPJ:

(a) Approximately fifteen (15) to twenty (20) minutes prior to the Releasor's stated return time, CPJ personnel will enter the vehicle, start it and allow it to idle for approximately ten (10) minutes in order to warm the interior and assist in defrosting the windows. In connection with such, the Releasor gives CPJ and its employees permission to enter the Releasor's vehicle. The Releasor acknowledges that the vehicle may be left running and unattended, and releases CPJ from any liability for theft, vandalism, or third-party interference occurring while the vehicle is idling.

(b) CPJ personnel will blow off snow from the windshield and windows to within approximately one (1) centimetre of the surface, and will not perform any close-to-body removal of snow or ice.

(c) If brushing is required in the opinion of CPJ personnel, CPJ personnel will attempt to brush off snow using only soft-bristle brush. CPJ will not move or drive the vehicle. The Releasor acknowledges that the ten (10) minute start is intended to allow the Releasor to enter the vehicle with the windows either in the process of defrosting, or otherwise adequately defrosted. The Releasor acknowledges and accepts that they may need to perform their own satisfactory final scrape of the windshield and windows before driving.

(d) Should CPJ not be able to start the vehicle due to safety reasons, extreme weather, or mechanical issues (including being unable to unlock the vehicle or a FOB being unable to start the vehicle), CPJ shall, as the Releasor's sole and exclusive remedy, refund the Warm Car Start Services fee. FOR CLARITY, ANY PARKING FEE PAID BY THE RELEASOR WILL NOT BE REFUNDED. 

3. Exclusions and Limitations on the Warm Car Start Services

The Warm Car Start Services are limited to the above, and do not include any repair, maintenance, mechanical diagnosis, towing, or any assurance that the vehicle will start, operate properly, or be warmed to any particular temperature. Without limiting the foregoing, the Warm Car Start Services carry the following exclusions and limitations:

(a) Should the fuel level of the Releasor's vehicle be below one-eighth (1/8th) of a tank, or should the vehicle's low fuel indicator be on, CPJ reserves the right to not start the vehicle.

(b) CPJ may, at its sole discretion, use a third-party flight tracking tool to attempt to better match the time at which it delivers the Warm Car Start Services, based on flight information provided to CPJ by the Releasor. CPJ makes no representations or warranties as to the accuracy or availability of third-party flight tracking data. If, due to any reason whatsoever, flight information is not provided, is inaccurate, or is unavailable, CPJ will not be liable for any failure to deliver the Warm Car Start Services. Furthermore, CPJ will not be obligated to re-start the vehicle a second time in the event of late arrival, and will not be obligated to change the time at which CPJ intends to deliver the Warm Car Start Services.

4. Release

(a) The Releasor (which includes the Releasor's executors, heirs and assigns) releases and forever discharges the Releasee and its administrators, successors, assigns, agents, representatives, employees, independent contractors, subcontractors, officers, directors, trustees, partners, associates, insurers and affiliates from all claims, demands, actions, liabilities, losses, costs and damages of any kind, whether in law or in equity and whether known or unknown, that the Releasor has, may have, or may in the future have, arising out of or in connection with the Warm Car Start Services, including any claim arising from the negligence or of the Releasee. This includes, without limitation, any personal injury, vehicle or property damage or loss, consequential or indirect damages, damage caused during snow or ice removal, and loss of car keys (and anything attached to them, including key chains, key rings, house keys, and keyless FOBs for a home, vehicle or otherwise).

(b) The Releasor acknowledges that pre-existing damage and conditions of their vehicle, including deficiencies of the body, cracked windshields, or distressed glass, may be exaggerated or amplified by the running of heat and defrosting features of the vehicle or by weather events such as hail, creating new cracks or damage that was not present on drop-off. The Releasor hereby releases all claims against and liability of the Releasee relating to such. The Releasor acknowledges that it is the Releasor's sole responsibility to document the condition of the vehicle at the time of drop-off.

(c) The Releasor accepts all risk of loss or liability relating to the Warm Car Start Services from the date this Release is signed. This Release may be delivered through CPJ's automated service portal or by any other method CPJ accepts in writing
